We have years of experience representing clients in the insurance industry as well as in insurance-related litigation. As a lead defense counsel in Kramer v. Phoenix Insurance Co., et al, we were successful in obtaining a landmark New York Court of Appeals decision holding that New York law allows a person to procure an insurance policy on his or her own life and then unrestrictedly transfer or sell that policy to a hedge fund, bank, or other investor. Our principal client in that case was the insurance broker who orchestrated the transactions at issue. This decision has been the subject of extensive media commentary given the multi-billion dollar life settlement market and the pronounced effect of the Kramer decision on the enforceability of secondary life settlement market transactions. We have handled a multitude of life settlement cases in federal and state court throughout New York, New Jersey, Pennsylvania, Delaware, and Minnesota.
We also successfully represented an insurance brokerage company specializing in the underwriting of HAZMAT insurance in a series of litigations in both federal and state courts brought by an ex-partner of the insurance brokerage company seeking a multi-million dollar recovery based on a claim of usurpation of corporate opportunity. In the federal action we obtained sanctions and attorney’s fees on behalf of our client and were commended by the federal judge as to the quality of our advocacy.
